OPENING CEREMONIES

1. CALL MEETING TO ORDER

Mayor Millsap called the Special City Council Meeting to order at 7:06 P.M. in the Multi Purpose Room, 1245 Hacienda Road, La Habra Heights, California. She noted that this meeting is for a Closed Session.

2. ROLL CALL

Present: Mayor Tela Millsap, Mayor Pro Tem Brian Bergman, Councilmembers Stan Carroll, Fred Klein and Margarita McCoy. Councilmember Bruce Douglas arrived approximately 7:16 P.M. and went to the Closed Session.

3. FLAG SALUTE

Mayor Millsap led the flag salute.

The City Council went into Closed Session at 7:06 P.M.

CLOSED SESSION

4. A point has been reached where, in the opinion of the City Council/Agency on the advice of its legal counsel, based on the below-described existing facts and circumstances, there is a significant exposure to litigation against the City Council/Agency as follows:

G.C. 54956.9 (b):

A statement was made by: Brian Leroy, counsel for BSI outside an open meeting of the City regarding re-zoning of BSI Property and a record of the statement was made by: Sandra Levin, City Attorney prior to the meeting and is available for public inspection in the City Clerk’s office.

The City Council returned from Closed Session at 7:39 P.M.

City Attorney Levin stated that no reportable actions were taken during Closed Session.

ADJOURNMENT

Mayor Millsap adjourned to the September 25, 2006 Adjourned Regular City Council Meeting at 7:39 P.M.
