AUGUST 4, 2008

 

 

OPENING CEREMONIES

 

1.             CALL MEETING TO ORDER

 

Mayor Carroll called the Special City Council Meeting to order at 6:30 p.m. on August 4, 2008 in the Multi Purpose Room at 1245 Hacienda Road, La Habra Heights, California.

 

2.             ROLL CALL

 

Present: Mayor Stan Carroll, Mayor Pro Tem Howard Vipperman and Council Members Brian Bergman and Layne Baroldi.

Absent: Tela Millsap.

Also Present: City Attorney Sandra Levin (by conference call), Interim City Manager Shauna Clark

 

3.             FLAG SALUTE

 

Layne Baroldi led the flag salute.

4.         HEARING ON REPORT AND ASSESSMENT FOR WEED ABATEMENT FEES PAST DUE

 

            RESOLUTION 2008-21 – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA HEIGHTS CONFIRMING A REPORT OF COSTS INCURRED IN THE ASSESSMENTS AND LIENS SET FORTH IN SUCH REPORT; AND DIRECTING THAT SUCH ASSESSMENTS BE COLLECTED ON THE PROPERTY TAX ROLL

 

            RECOMMENDATION:                   Adopt Resolution 2008-21.

 

            Mayor Carroll opened the Meeting for Public Comment.

 

            Stephen Blagden, Citron Road, stated that there are two factions in the City. One faction wants the city to remain rural and the other wants more and bigger development. He suggested that the 2009 election will deal with the developer faction doing more building under the guise of increasing money for the City. The fastest path to unrestrained building will be to turn the City back to the County. All the City has to do is overspend its way into financial ruin.

 

            Council Member Baroldi stated that the CityÕs finances are doing well under this Council and with the help of the Interim City Manager. He stated that he had sent an E-mail to a former mayor as a humorous comment and nothing malicious was meant and he apologized for it.

 

            Jessica Winship, Cypress, thanked the Council for all the hard work they have done. She noted that in her opinion Ms. Clark was the best thing that ever happened to this City.

 

            Interim City Manager Clark stated that the City does weed abatement all year with a big push in May. When people do not abate their weeds we have the right to do the abatement work and put a lien on the property for the cost of the abatement and all administrative costs leading up to it. We have a total of $45,000 to put on the tax roll before the August 10th deadline.

 

            Council Member Baroldi mentioned the dangerous fire area ridge of Powder Canyon which belongs to the Habitat Authority that has not been abated. He asked if there had been any agreement with them over abatement in the contract between the City and the Habitat Authority.

 

            Interim City Manager Clark stated that they will research that.

 

            Mayor Carroll opened the Public Hearing for anyone wishing to speak on this Item. As no one came forward, he closed the Public Hearing.

 

            Council Member Vipperman moved to adopt Resolution 2008-21 as written above. The motion was seconded by Council Member Baroldi and approved as follows:

 

            AYES: Baroldi, Bergman, Carroll and Vipperman

            NOES: None

            ABSENT: Millsap

 

5.         RESOLUTION 2008-22 – A RESOLUTION OPPOSING FISCALLY IRRESPONSIBLE STATE BUDGET DECISIONS THAT WOULD ÒBORROW LOCAL GOVERNMENT FUNDSÓ

 

            RECOMMENDATION:                   Adopt Resolution 2008-22.

 

            Interim City Manager Clark explained that the League of California Cities has started a campaign to address what the State of California is doing or not doing with City Budgets. The Stated Budget has still not been adopted and in order to close the $15 billion gap, the Legislature is still looking at subventions (money that comes to the Cities from the State that Cities are usually able to count on.) This Resolution is to be sent along with other Cities as a protest to the State of California. Ms. Clark broke down the money we might expect to lose that we could have expected to get from the State:

 

            COPS                                                 $100,000

            GAS TAX MONEY

            (If not released we will have to

            use reserves and lose interest)   $400,000

            10% of PROPERTY TAXES          $ 98,000

 

            Council Member Baroldi moved to adopt Resolution 2008-22 as noted above. The motion was seconded by Council Member Vipperman and approved as follows:

 

            AYES: Baroldi, Bergman, Carroll and Vipperman

            NOES: None

            ABSENT: Millsap

 

PUBLIC COMMENT

 

            Mayor Carroll announced that the City has a Subscription Service for Paramedic response. It is $45 per year per household and if you have subscribed there will be no Paramedic charge for their response. He noted that it is $45 for the calendar year and is not pro-rated if paid later in the year.

 

ADJOURNMENT

 

            Mayor Carroll adjourned the August 4, 2008 Special City Council Meeting to the next regular City Council Meeting on August 14, 2008.
